Procedure:
On the 26th May 2016, the complainant referred a complaint for adjudication to the Workplace Relations Commission pursuant to the Redundancy Payments Acts. The complaint was scheduled for adjudication on the 26th July 2016. The complainant attended in person. Mary Jane McFerran, Peninsula represented the respondent.
In accordance with section 39 of the Redundancy Payments Act, 1967 following the referral of the complaint to me by the Director General, I inquired into the complaint and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint.
Submissions:
The parties were in agreement that a redundancy situation arose in this case. They were also in agreement that the employment began on the 12th April 2012, that notice of termination was given by the respondent on the 12th May 2015 and that the employment came to an end on the 12th June 2015. They also agreed that the complainant’s gross weekly wage was €682.50.
Decision:
Section 39 of the Redundancy Payments Act requires that I make a decision in relation to the complaint.
In accordance with the findings contained in this report, I am satisfied that a redundancy situation occurred in respect of the complainant and that he is entitled to a redundancy lump sum payment under the Redundancy Payment Acts, 1967 to 2014, based on the following information:
Date of birth: 13th July 1962
Employment commencement date: 12th April 2012
Date notice given of end of employment: 12th May 2015
Employment end date: 12th June 2015
Average weekly wage: €682.50
These awards are made subject to the complainant having been in insurable employment under the Social Welfare Acts during this employment.
